Quote

They made everything easy for me! Even when I lost faith in the car accident where a drunk driver hit me, they helped me through every process. They were quick as they could be and made everything easier for me while being in the process of my move to Japan for the Navy, full time student, and planning my own wedding. I appreciated the help. Thank you!”

I had the pleasure of allowing Mr. Leland Malchow to represent my case and I would recommend 10star rating if possible. Not only was Mr. Leland very professional and knowledgeable, he also took the time to listen to my frustrations about my situation. He offered a listening ear, as well as some kind motivational advice. Our relationship has been through business only but I would extend a hand to him and the law firm from here on out. Thank you all and God Bless."

The Hidden Dangers at the Pump

Gas stations are everywhere. They’re on every corner, open late, and part of our daily routine. But they’re also full of risks that can turn dangerous in a flash.

Car Accidents at the Pumps

Busy stations, tight spaces, and distracted drivers can lead to collisions—especially when people are pulling in and out quickly or ignoring traffic patterns. If you’re hit while pumping gas, those injuries can be severe, even life-changing.

Slip and Fall Incidents

Leaking fluids, spilled drinks, rainy conditions, or poorly maintained surfaces can lead to slip and falls. A fractured wrist or broken hip can derail someone’s entire life.

Burns from Leaking Nozzles or Malfunctions

Gasoline is flammable and toxic. If a nozzle leaks, malfunctions, or sprays at high pressure, it can cause chemical burns, fires, or inhalation injuries.

Lacerations and Cuts from Faulty Equipment

Broken pump handles, jagged metal, shattered windows—these aren’t rare. When equipment isn’t inspected or replaced, serious cuts and infections can follow.

Each of these situations can lead to real harm. And when they do, someone is often responsible.

Assault or Theft at the Station

Not all dangers at gas stations come from equipment or accidents. Some come from other people. Poor lighting, lack of cameras, or absent security can create an environment where assaults or thefts happen. If you were robbed, attacked, or felt unsafe and the gas station failed to provide basic protections, you may have a claim.

These are deeply personal and traumatic experiences. And while the criminal justice system handles the attacker, a civil case may help you recover for what you’ve been through.

Each of these situations can lead to real harm. And when they do, someone is often responsible.

Who’s Responsible After a Gas Station Injury?

This is the big question, right? Who pays for the bills, the pain, the time you’ve lost?

Under both South Carolina and Georgia law, gas stations have a duty to keep their premises reasonably safe. That means:

  • Fixing leaks or hazards quickly.
  • Keeping walkways and pumps clean and dry.
  • Repairing broken equipment.
  • Training staff to recognize and respond to danger.
  • Providing reasonable security in high-crime areas.

If the station fails to do that—and someone gets hurt—they can be held accountable.

Understanding Premises Liability

These kinds of cases fall under what’s called “premises liability.” It’s a legal concept that basically means property owners have a responsibility to prevent injuries to customers and visitors. And it applies to gas stations just like it would to a grocery store or restaurant.

But there’s more to it than just pointing fingers. Every case is different. Maybe it was a malfunctioning nozzle. Maybe another driver caused your injuries. Maybe the gas station had security footage, and maybe they didn’t.

South Carolina vs. Georgia: The Laws Matter

If your injury happened in South Carolina or Georgia, the laws that apply are slightly different—but both states give injured folks a clear path to pursue compensation.

In South Carolina:

Modified Comparative Negligence applies. That means you can still recover damages as long as you are 50% or less at fault for the accident.

Statute of Limitations: You have three years to file a personal injury claim.

In Georgia:

The state uses a Modified Comparative Negligence rule too, but your share of fault must be less than 50% to recover damages.

Statute of Limitations: You have only two years to file a personal injury claim.

Those few percentage points—and that extra year in South Carolina—can make a big difference. That’s why having a legal team that understands both systems is so critical.

What To Do Right After a Gas Station Accident

When something like this happens, your first thought is probably, “What now?” Here’s a simple plan:

  1. Get medical attention. Even if it seems minor, let a doctor decide. Some injuries take time to show up.
  2. Report the incident. Talk to the manager. Ask for an incident report. Be calm and direct.
  3. Take photos. Of the scene, your injuries, the pump, the floor—everything. Details matter later.
  4. Get witness names. If anyone saw what happened, ask for their contact info.
  5. Talk to a lawyer. You don’t have to sue. But knowing your rights is never a bad idea.

What Kinds of Damages Can You Claim?

If you were hurt at a gas station, you may be able to recover compensation for:

  • Medical bills (including future care)
  • Lost wages
  • Pain and suffering
  • Emotional distress
  • Permanent disability or scarring

In wrongful death cases, families can seek damages for funeral expenses, lost companionship, and more.

Why These Cases Can Get Complicated

Gas station owners are often backed by large insurance companies. They’ve got teams ready to protect their interests, and they move fast.

Sometimes they fix the hazard before you can document it. Sometimes they “lose” security footage. Sometimes they try to blame you.

We’ve seen all of that—and more. That’s why it’s critical to have someone in your corner who knows how to gather evidence, talk to witnesses, preserve surveillance, and build a strong case from day one.
