What should I do if my automobile was hit by a train in Augusta?
We were recently contacted by a young man who was injured when a train struck his automobile at a railroad crossing in Evans, Georgia. He asked me what his rights were. If you’re reading this, you may have similar questions. I’ll tell you what I shared with that client.
Georgia is a comparative negligence state. If that injured person can prove that the train was speeding or the train did not blow the whistle appropriately or did not have crossing arms, warning signs, or lights, then he may be able to prove that the railroad is comparatively negligent. If the railroad is responsible for 51% or more of his injuries, then he may be able to recover for his injuries against the railroad.
If you have any questions about your railroad intersection case, give us a call. We’d be happy to help.
