I met with a client recently who was involved in a nighttime pedestrian automobile accident on Washington Road. The client was getting off work from the Waffle House, and was crossing in a crosswalk when he was struck by an automobile turning left into the crosswalk. I learned of certain mistakes the client had made a month before he’d hired me. One mistake the client made was that he had given a recorded statement to the insurance adjuster a day after his accident. In that recorded statement, the client was coaxed by the insurance adjuster to admit that it was dark close to the crosswalk. I tell all clients that I represent to never give a statement to an insurance adjuster. I also tell clients to seek legal representation immediately from experienced lawyers who deal with pedestrian automobile accident cases on a regular basis. It’s important that the lawyer educate the client and tell them what to say and not say in the case. I always tell clients not to speak to insurance adjusters. In this client’s case, I was able to show the different bright lights around the intersection and prove that the client was visible due to his yellow Waffle House uniform clothing, garnering the client a good result in the case.
