What if I do not know the answer to a deposition question?
Many times, our clients are worried about not knowing an answer to a question in a deposition. We counsel our clients before the deposition that it’s okay, if you know the answer, tell the lawyer the answer; if you don’t, say, “I don’t know the answer.” In Georgia, if you have any questions during the middle of the deposition, we’re allowed to stop the deposition, walk into the other conference room, and discuss the issue that you have during the deposition.
Again, you’re only required to answer issues that you have knowledge of. If you have no knowledge, you just tell the lawyer, “I have no knowledge.” If the lawyer ever asks anything improper, we will object to it and instruct you not to answer the deposition.
