Question:
Should I talk to an insurance company after a dog bite injury?
Answer:
Last week, we spoke to a woman who had that very question. She had been mauled by a pit ball and she did not know what to do. She only knew that she had medical bills, that she was going to be out of work for a long time, and that she was confused. She believed that in order to get those bills paid for and to get paid back for the lost wages, she was going to have to give a recorded statement to the insurance company. If you’re reading this and in a similar circumstance, and you’re wondering if you should speak to the insurance company, I think that any attorney will tell you no. I will tell you no.
There is absolutely nothing good that will come from you giving a statement to the insurance company. For one thing, the insurance company is only taking your statement to determine the validity of your claim. If they can discredit your claim in any way through the answers you give to questions that they ask, then your claim is going to be diminished. The questions that they’re going to ask you are going to seem honest, and they’re going to seem like questions that are just designed to see if you truly are hurt or how badly their insured messed up. In reality, they probably already talked to their insured, and they know what happened in the dog bite. Who knows, they may have insured prior events involving this same dog.
It’s not in your best interest to speak to the insurance company. They will ask you questions in a certain order. They will phrase the questions in a way to discredit you, to discredit your injuries. They will try to back you into a corner as early on in the case as possible. If you are in this position and you have questions about what you should do, don’t talk to an insurance company. If you would like to speak with us, we’re available at any time and would love to sit down with you and answer any questions that you have about your dog bite case.
