If that injured person can prove that the train was speeding or the train did not blow the whistle appropriately or did not have crossing arms, warning signs, or lights, then he may be able to prove that the railroad is comparatively negligent. If the railroad is responsible for 51% or more of his injuries, then he may be able to recover for his injuries against the railroad.
